Parents, 

Students at the School District of Bowler have a right to attend school regardless of immigration status, a student’s mere attendance at school does not violate the law or create an exigent circumstance that would support ICE having access to a student without a judicial warrant issued and signed by a state or federal judge. A child also has the right against self-incrimination and may not be required to provide any information that would establish his or her residency status. 

You may have the question of if ICE officers arrive at school, would we let them in? 

They should never be allowed past the locked entrance areas until the following criteria have been met (in any order): 

1. An administrator has been called, and is present, and that administrator has been in direct contact with our lawyer. 

2. The administrator has called and notified parents. 

3. They have a judicial warrant (an administrative warrant does not count) that is issued and signed by a state or federal judge (a county judge or municipal judge does not count) that we have made a photocopy of. Before any access, the warrant should also be checked for: 

-the exact correct address and directed specifically to the school or person. -to be executed within the time period specified on the warrant. 

-That the warrant has the appropriate Court name on it (i.e. United States Court for the Eastern and Western Districts of Wisconsin). 

4. The ICE agent(s) have identified themselves and their identification has been verified and photocopied by the School District of Bowler. 

You may have a question about what happens outside at recess, during gym class, or on field trips? 

1. Staff should escort the student to the office or the appropriate authority on a field trip. The school office will then follow the directions listed above and/or the staff and student, in the event of a field trip, will return to the School District of Bowler Office where the directions listed above will be followed.
